The Court recently ruled on the motion to dismiss the implied warranty and written warranty claims. The Court denied Ford’s motion to dismiss the implied warranty claim. The Court granted the motion as to the written warranty claim and dismissed that claim. In the previous hearing the claims under the Illinois Consumer Fraud Act and common law fraud were sustained.
So what does this mean? The case is moving forward with the Illinois Consumer Fraud Act, common law fraud, and implied warranty of merchantability claims still intact.
